Terms & Conditions
These terms apply to every order placed with Mama Rosa Catering. We keep them short and in plain English. Only where the law requires precision do we go more precise.
1. Who we are
Mama Rosa Catering, registered at Cinemadreef 52, 1325 EM Almere, the Netherlands. VAT NL005293503B96. Email info@mamarosa.nl. Referred to below as "we" or "Mama Rosa".
2. Who these terms apply to
The company that opens an account with us (the Customer) and every employee of that company who orders a lunch via our platform (the User). The Customer is responsible for who gets access to its account.
3. Ordering
Orders are placed via your account on mamarosa.nl. Every User orders and pays for their own lunch. The Customer is not a party to the individual payment of its employees.
4. Cutoff and delivery
The cutoff for a delivery date is 10:00 (Europe/Amsterdam). Until that moment you can order, change or cancel for that date. We deliver at the agreed time (standard 12:15 to 12:45) in Almere at the address listed on your account.
5. Payment
You pay immediately when placing the order via iDEAL or credit card. We do not send invoices after the fact. Payment is processed by Stripe; we only receive the transaction reference and the last four digits of your payment method.
6. Delivery fee
We charge a fixed delivery fee per person. Mama Rosa sets this amount; it can also be zero, in which case delivery is free. You see the exact amount before you place and pay for the order. There is no recalculation after the fact.
7. Cancellation and refunds
Orders are binding from 10:00 on the delivery date. Until then you can cancel free of charge via your account; the full amount is refunded automatically.
After 10:00 refunds are not possible, because we have procured and prepared the fresh ingredients at that point. This falls under the exception to the right of withdrawal for "perishable goods" as set out in article 6:230p sub f of the Dutch Civil Code.
For exceptional situations such as illness, unexpected office closure or allergy incidents, call Mama Rosa directly on +31 36 785 8241. We review every case personally and may offer a replacement lunch or partial refund at our discretion.
8. Allergens and dietary requirements
We list allergens on the menu. The kitchen confirms allergens before your first order. Notify us of allergies at registration. We cook in a kitchen where gluten, nuts, milk, eggs, soy and shellfish are present, cross-contamination cannot be ruled out. For life-threatening allergies we recommend contacting us before your first order.
9. Liability
Our liability is limited to the amount of the order in question. We are not liable for indirect damages, lost revenue or consequential damages. This limitation does not apply in cases of intent or gross negligence.
10. Personal data
We process personal data in accordance with our Privacy Policy. Every User is an individual data subject, the Customer is not a processor of those data.
11. Changes
We may change these terms. For material changes we notify you by email. Amended terms apply to orders placed after the publication date.
12. Governing law
These terms are governed by Dutch law. Disputes are submitted to the District Court of Midden-Nederland, Lelystad location.
